If you do not agree to these Terms, you must strictly refrain from using our services.
1. General Provisions
These Terms constitute a legally binding agreement between you (“User,” “Student,” or “You”) and Bar Essentials PH (“Company,” “We,” “Us,” or “Our”), encompassing all content, features, and functionalities available on our website.
2. Intellectual Property Rights
All content provided on Bar Essentials PH, including but not limited to video lectures, case digests, quizzes, handouts, text, graphics, logos, and software, is the exclusive property of Bar Essentials PH and is protected by the Intellectual Property Code of the Philippines (Republic Act No. 8293).
- License to Use: You are granted a limited, non-exclusive, non-transferable, and revocable license to access and view the course content for your personal, non-commercial educational use only.
- Prohibitions: You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer any content unless we explicitly give you written permission to do so.
3. Account Usage and Security
To access our courses, you must create an account. You agree to provide accurate, current, and complete information during registration.
3.1. “One Person, One Access” Policy
Your account is personal to you. We strictly enforce a “One Person, One Access at a Time” policy. Concurrent logins on multiple devices or sharing of login credentials with third parties is strictly prohibited.
3.2. Prohibition on Account Sharing
Sharing your account credentials (username and password) with any other individual is a material breach of these Terms.
- Monitoring: We utilize advanced tracking mechanisms to detect simultaneous usage, unusual login patterns, or IP discrepancies.
- Show Cause Order: If we suspect that your account is being shared or accessed by unauthorized persons, we will issue a Show Cause Order to your registered email address. You will be required to explain, within a prescribed period, why your account should not be permanently deleted and why your access should not be restricted.
- Penalties: If the explanation is deemed unsatisfactory or if unauthorized sharing is proven:
- Your account will be immediately suspended or permanently terminated without refund.
- We reserve the right to file appropriate civil and criminal charges against you for violation of the Intellectual Property Code and other relevant Philippine laws.
4. Course Access and Duration
4.1. Standard Access
Unless otherwise specified as “Lifetime Access” at the time of purchase, you are granted access to the purchased course materials for a period of one (1) year from the date of purchase. After this period, access will automatically expire.
4.2. Content Modifications
Bar Essentials PH is dedicated to keeping materials up-to-date with current laws and jurisprudence. We reserve the right to update, modify, add, or remove course contents, lectures, or materials at any time without prior notice. These updates are included in your access rights for the duration of your term.
5. Payments and Refund Policy
By purchasing a course, you agree to the following strict refund guidelines tailored for digital goods.
5.1. Refund Window
Refund requests must be made within thirty (30) calendar days from the time of purchase. Requests made after this window will be denied.
5.2. Condition for Refund (The “No-Start” Rule)
Refunds are only available if you have not started the course. Once you have accessed, viewed, or downloaded any portion of the course content (e.g., clicked “Start Course,” watched a video, or downloaded a PDF), you waive your right to a refund.
5.3. Indivisibility of Bundles and Coupons
Courses purchased as a bundle or using a discount coupon are considered indivisible.
- Example: If you purchase five (5) courses using a single coupon or bundle deal and you start one of them, you are no longer eligible for a refund for the remaining four (4) courses. The “No-Start” rule applies to the entire transaction.
5.4. Processing
- To request a refund, you must email support@baressentialsph.com with your transaction details.
- Valid refund requests will be processed within seven (7) days upon our receipt of the request.
6. Data Privacy
We value your privacy and comply with the Data Privacy Act of 2012 (R.A. 10173). We collect and process your personal information solely for the purpose of providing our educational services, processing payments, and verifying account security. We do not sell your data to third parties.
7. Limitation of Liability
To the fullest extent permitted by law:
- Bar Essentials PH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of our services.
- While we strive for accuracy, we do not warrant that the course materials are free of errors or that they will guarantee specific results in the Bar Examinations or law school recitations. The materials are intended as supplementary educational tools.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
- Any dispute arising out of or related to these Terms shall be settled amicably.
- If amicable settlement fails, the courts of Davao City, Philippines shall have exclusive jurisdiction, to the exclusion of all other courts.
